1. Introduction
1.1. OnlineDoc (“OnlineDoc”, “we”, “us”, “our”) operates an information technology platform consisting of applications, websites, content, products and services (collectively, the “OnlineDoc Platform” or “Platform”).
1.2. The OnlineDoc Platform enables registered users (“Users”, “you”, “your”) to:
- access telehealth services provided by independent healthcare providers who are appropriately registered and licensed to practise in Ireland or in another relevant jurisdiction within the European Economic Area (“Authorised Providers”);
- access certain other health-related and administrative services; and
- store, manage and share certain personal data and personal health information.
1.3. Telehealth means healthcare delivered through interactive text, audio and/or video technology where the patient and the healthcare provider are not in the same physical location (“Telehealth Services” or “Healthcare Services” when provided through the Platform).
1.4. The Platform also allows Users to:
- store certain personal and health information, including clinical notes, prescriptions, certificates and other documents (“Personal Health Information” or “PHI”);
- share PHI with Authorised Providers;
- electronically receive and store prescriptions, medical certificates, sick notes and other documents; and
- use optional services at the User’s request, such as:
- secure electronic transmission of consultation summaries to another healthcare provider chosen by the User;
- secure transmission of prescriptions to the User’s chosen pharmacy;
- notifications relating to prescription readiness or collection;
- where available, secure sharing of information with prescription delivery services or other integrated third-party providers.
1.5. OnlineDoc may introduce additional optional services from time to time. Any new features or services will also be subject to these Terms, and may be subject to additional specific terms.
2. Agreement with OnlineDoc
2.1. These Terms & Conditions (“Terms”) govern your access to and use of the OnlineDoc Platform, including your participation in any programmes offered by OnlineDoc (as defined below).
2.2. By registering for an account, accessing or using the Platform, you confirm that:
- you have read and understood these Terms; and
- you agree to be legally bound by them.
2.3. If you do not agree with these Terms at any time, you must immediately stop using the Platform and any associated OnlineDoc programmes.
2.4. These Terms also govern your participation in any OnlineDoc:
- Referral Programme
- Purchasing Credit Programme
- Gift Card Programme
(collectively, the “OnlineDoc Programmes”).
3. User Representations and Warranties
By accessing or using the Platform, you represent, warrant and acknowledge that OnlineDoc is relying on the following:
3.1. Eligibility and Residency
You confirm that:
- you are at least 18 years of age and have the legal capacity to enter into binding agreements; and
- you are physically located in a jurisdiction where OnlineDoc is legally permitted to operate at the time you request Healthcare Services; and
- you will ensure that these eligibility and residency requirements continue to be met whenever you request or receive Healthcare Services.
3.2. Minors and Age of Consent for Healthcare in Ireland
In accordance with Irish health law:
- Users aged 18 and over may create an account and access Healthcare Services independently.
- Individuals aged 16 or 17 may legally consent to medical treatment; however, OnlineDoc requires that a parent or legal guardian:
- creates and manages the account on their behalf, and
- supervises their use of the Platform.
- For individuals under 16 years of age, all Healthcare Services must be requested, managed and supervised exclusively by a parent or legal guardian who has lawful authority to act on their behalf.
OnlineDoc may request proof of age or legal authority where clinically or legally necessary.
3.3. Authority for Registered Dependents
If you use the Platform on behalf of a Registered Dependent (including a child or a person for whom you have lawful authority):
- you confirm that you are legally authorised to act on their behalf;
- you are authorised to make decisions relating to their healthcare;
- you consent to the sharing of their personal data and PHI with OnlineDoc and Authorised Providers as required;
- you will ensure that all information provided on behalf of the Dependent is accurate and complete.
3.4. Personal and Non-Commercial Use
You will use the Platform solely for:
- your own personal, non-commercial use; or
- the personal, non-commercial use of Registered Dependents for whom you lawfully act.
You will not use the Platform for any commercial, research, analytical or data-mining purposes unless expressly permitted in writing by OnlineDoc.
3.5. Truthfulness and Accuracy of Information
All information you provide to OnlineDoc and to Authorised Providers will be:
- accurate, complete and up to date; and
- promptly updated if it changes.
You understand that inaccurate or incomplete information may limit a Provider’s ability to deliver safe and appropriate Healthcare Services.
4. Nature and Scope of Healthcare Services
4.1. Authorised Providers and relationship with Users
- Only appropriately regulated health professionals (“Authorised Providers”) may provide Healthcare Services via the Platform.
- Authorised Providers may be, for example, registered medical practitioners (doctors), nurses, pharmacists, psychotherapists, psychologists or other regulated health professionals.
- In Ireland, Authorised Providers will generally be registered with the relevant professional regulatory body (such as the Irish Medical Council, Nursing and Midwifery Board of Ireland, Pharmaceutical Society of Ireland, CORU, or other competent authority), or with the competent authority of another EEA Member State where permitted by law.
4.2. Independent providers
- Authorised Providers use the Platform as independent contractors.
- They are not employees, agents or representatives of OnlineDoc when they provide Healthcare Services.
- The relationship in respect of clinical care is strictly between you and the Authorised Provider (the healthcare professional-patient relationship). OnlineDoc is not a party to that relationship.
4.3. Not a replacement for primary care
- Healthcare Services delivered via the Platform are not a substitute for face-to-face primary care or emergency services.
- OnlineDoc does not act as your GP (general practitioner) or primary care provider.
- We strongly encourage you to maintain a regular relationship with a GP or primary care provider.
- OnlineDoc does not automatically provide a copy of your consultation to your GP; however, where functionality exists, you may instruct the Platform to share a summary with your chosen provider.
4.4. No guarantee of outcome
- As with any healthcare service, no outcome, result or cure is guaranteed.
- An Authorised Provider may decide that Telehealth Services are not suitable for some or all of your needs, or that they are not permitted to provide certain services remotely or in your jurisdiction. In such cases, they may decline or discontinue services and may advise you to seek in-person care or emergency services.
5. Healthcare Services - Terms of Use
As a condition of receiving Healthcare Services via the Platform, you acknowledge and agree that:
5.1. OnlineDoc is a technology platform that connects Users (and any Registered Dependents) with Authorised Providers for the provision of Healthcare Services. OnlineDoc itself:
- is not registered or licensed to provide medical or healthcare services;
- does not provide medical diagnoses, treatments, or clinical decisions;
- is not responsible for clinical judgment, professional standards of care, or clinical record-keeping.
5.2. Responsibility of Authorised Providers
- Authorised Providers are solely responsible for the Healthcare Services they provide, including:
- compliance with applicable law and regulatory requirements;
- adherence to professional standards of care;
- proper clinical record-keeping;
- compliance with data protection and privacy law when acting as controllers of clinical data.
5.3. Jurisdiction and regulatory differences
- Regulations governing telehealth differ between jurisdictions and may change.
- The availability and scope of Healthcare Services can depend on:
- your location at the time of the consultation; and
- the jurisdiction(s) in which the Authorised Provider is licensed.
- You agree that the Provider may verify your location and may decline or discontinue services if they are not permitted to treat you where you are.
5.4. Use only for yourself and dependents
- You will only request Healthcare Services:
- for yourself; or
- for Registered Dependents for whom you have legal authority to act.
5.5. Information provided to the Provider
- You are responsible for providing all information that the Authorised Provider considers necessary to assess and treat you.
- If you refuse or fail to provide requested information, the Provider may be unable or unwilling to provide Healthcare Services.
5.6. Telehealth risks
You understand that telehealth carries specific risks, including (but not limited to):
- the information transmitted may be insufficient (for example, poor image quality or incomplete data) for clinical decision making;
- delays in consultation or treatment due to failures, latency or breakdown in electronic communications or systems;
- in some cases, lack of access to complete medical records may increase risks (for example, potential for adverse drug interactions, allergy risks or incomplete medical history);
- although OnlineDoc uses appropriate technical and organisational measures to protect data, no system is completely secure and there is a residual risk of unauthorised access, data breach or loss.
Further information is contained in the OnlineDoc Privacy Policy, which forms part of these Terms.
5.7. Emergency care exclusion
- The Platform must not be used for medical emergencies.
- If you believe you are experiencing an emergency, you must immediately call 999 or 112, or attend your nearest emergency department.
5.8. Conditions not suitable for OnlineDoc
Without limitation, the following symptoms or circumstances are not suitable for treatment via the Platform and require urgent or in-person assessment:
- chest pain or suspected heart attack or angina;
- difficulty breathing or shortness of breath at rest;
- sudden severe headache with neurological symptoms;
- stroke-like symptoms (e.g. weakness or paralysis on one side, facial droop, difficulty speaking or understanding speech);
- blackouts, loss of consciousness, or feeling like you are about to faint;
- severe abdominal pain or pain so intense that you cannot walk comfortably;
- high fever in infants, or other conditions flagged by public health or emergency guidelines as requiring urgent care.
This list is illustrative, not exhaustive. When in doubt, you should seek emergency or in-person care.
5.9. Prescribing limitations
- Authorised Providers may be legally or professionally restricted from prescribing certain medications via telehealth, such as:
- controlled drugs, narcotics or sedatives;
- medicines with a high risk of abuse or dependency;
- medicines that require close in-person monitoring or regular investigations.
- The decision whether to prescribe any medication is solely at the discretion of the Authorised Provider, in line with applicable law and professional guidance.
- There is no guarantee that a prescription will be provided.
5.10. Use of prescriptions
If you receive a prescription:
- it is solely for the personal use of the individual named on the prescription;
- you will carefully read all labels, leaflets and instructions, and consult a pharmacist or doctor if you have questions;
- you must never share prescribed medicines with another person.
5.11. Adverse events and side effects
- You must not use the Platform as the sole or primary channel to report urgent adverse events or severe side effects.
- You will promptly report medication reactions, serious side effects or suspected adverse events to:
- your prescribing doctor;
- your GP or primary care provider;
- your local out-of-hours or urgent care service; or
- emergency services (999/112) where appropriate.
5.12. Follow-up care
- You agree to seek follow-up or emergency care when advised to do so by an Authorised Provider, or when you reasonably believe it is necessary.
6. Technology-Related Terms
As a condition of using the Platform, you agree that you will not:
6.1.
- remove, obscure or alter any copyright, trademark or proprietary notices on the Platform;
- reproduce, modify, create derivative works from, distribute, license, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Platform except as expressly permitted by these Terms;
6.2.
- decompile, reverse engineer or disassemble any part of the Platform, except to the extent expressly permitted by applicable law and then only after giving prior written notice to OnlineDoc;
6.3.
- link to, mirror or frame any part of the Platform without our prior written consent;
6.4.
- launch or cause to be launched any automated system (including “robots”, “spiders”, “crawlers” or “scrapers”) that accesses the Platform for any purpose, including extracting data or overloading our infrastructure;
6.5.
- attempt to gain unauthorised access to, interfere with, damage or disrupt:
- any part of the Platform;
- any server, network or database connected to the Platform; or
- any user accounts other than your own;
6.6.
- impersonate any person or entity, or otherwise misrepresent your identity or affiliation;
6.7.
- use the Platform in any way that:
- breaches any applicable law or regulation;
- is fraudulent or misleading;
- is harmful, abusive, defamatory, obscene, harassing, or otherwise objectionable.
6.8. You will:
- keep your account login credentials secure and confidential;
- notify OnlineDoc immediately if you suspect any unauthorised access to your account;
- behave respectfully and use appropriate language in all communications with Authorised Providers, OnlineDoc staff and other Users.
6.9.
- Unless expressly permitted by OnlineDoc in writing, you may only create and use one account.
- You are responsible for all activities conducted using your account.
7. Termination and Effect of Termination
7.1. OnlineDoc may, at any time and for any reason, with or without notice:
- suspend or terminate your access to the Platform;
- suspend or terminate your participation in any OnlineDoc Programme;
- suspend, modify or discontinue the Platform or any portion of it.
7.2. On termination of your account:
- you will lose access to the Platform and any OnlineDoc Programmes;
- OnlineDoc will have no further obligation to provide services to you via the Platform, except where we are required by law to provide you with access to your data, including PHI.
7.3. Management of your PHI on closure of your account is described in the OnlineDoc Privacy Policy.
7.4. These Terms continue to apply for so long as you access any part of the Platform or participate in any OnlineDoc Programme.
8. Ownership and Intellectual Property
8.1. The Platform, including all content, software, design, interfaces, trademarks, logos and other intellectual property rights (excluding PHI and other User-generated content) are owned by OnlineDoc or its licensors.
8.2. Nothing in these Terms grants you any rights in or to:
- OnlineDoc’s trade name, logo, trademarks, service marks or brand elements; or
- any intellectual property rights belonging to OnlineDoc or its licensors,
except for the limited, revocable, non-exclusive, non-transferable licence to use the Platform in accordance with these Terms.
8.3. You may not copy, download, reproduce, modify, distribute, perform, display, or create derivative works of any content from the Platform, except as expressly permitted by these Terms or by OnlineDoc in writing.
9. Content
9.1. Information and materials made available on or through the Platform (collectively, “Content”), other than information communicated directly by Authorised Providers during a consultation, is provided for general information only and does not constitute medical advice, diagnosis, treatment, or endorsement of any particular treatment or product.
9.2. You are responsible for discussing any Content with an appropriate healthcare professional before relying on it. Any reliance you place on such Content is entirely at your own risk.
9.3. The Content may contain technical, typographical or other errors. While we use reasonable efforts to keep Content accurate and up to date, OnlineDoc does not warrant that such materials are accurate, complete or current.
10. Disclaimer - Platform and Services
10.1. The Platform and all services provided via it are provided on an “as is” and “as available” basis.
10.2. To the fullest extent permitted by Irish law and applicable EU law, OnlineDoc:
- disclaims all representations, warranties and conditions, express, implied or statutory, not expressly set out in these Terms, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment;
- does not guarantee:
- that the Platform or any services will be uninterrupted, secure or error-free;
- that any defects or errors will be corrected;
- any particular result from use of the Platform or Healthcare Services;
- the quality, suitability or safety of any Healthcare Services provided by Authorised Providers.
10.3. You use the Platform and any Healthcare Services at your own risk and are responsible for your own decisions regarding your health and care.
11. Limitation of Liability - Healthcare / Platform
11.1. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- any other rights you may have under mandatory consumer protection law which cannot be excluded.
11.2. Subject to the above, OnlineDoc (including its directors, officers, employees, shareholders, affiliates, agents and independent contractors) will not be liable for:
- any loss, damage or injury arising from your use of or inability to use the Platform;
- any loss, damage or injury arising from any Healthcare Services provided (or not provided) by Authorised Providers;
- any decisions you make or actions you take based on information obtained through the Platform.
11.3. Without limiting the generality of the foregoing, OnlineDoc will not be liable for:
- indirect, incidental, special, exemplary, punitive or consequential damages;
- loss of profits, business, revenue, opportunity, goodwill or data;
- professional negligence of Authorised Providers.
11.4. To the extent permitted by law, the maximum aggregate liability of OnlineDoc to you arising out of or in connection with your use of the Platform shall not exceed €500 (five hundred euro).
12. Indemnity
12.1. You agree to indemnify and hold harmless OnlineDoc (and its directors, officers, employees, agents and shareholders) from and against any and all claims, demands, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or in connection with:
- your use of the Platform and any Healthcare Services;
- your breach of these Terms;
- your violation of any law or the rights of any third party;
- Healthcare Services requested by you on behalf of any Registered Dependent;
- your misuse of any OnlineDoc Programme.
13. Fees and Payment
13.1. General
- Fees for Uninsured Healthcare Services or other services not covered by public funding, third-party payers or membership schemes (“Fees”) will be notified to you before you confirm a booking or use a service.
13.2. Currency and taxes
- All Fees are charged in euro (€).
- Fees are inclusive of Irish VAT where applicable, based on your billing location.
13.3. Pay-per-visit option
- You may pay Fees on a per-consultation or per-service basis.
- OnlineDoc may require valid payment card details in advance for authorisation and payment.
- If your payment card is invalid or declined, you may not be able to access services.
13.4. Membership option
- OnlineDoc may offer membership plans that provide access to specified Uninsured Healthcare Services during a fixed membership period for a flat fee (“Membership Fee”).
- The Membership Fee, the services covered and the duration of membership will be clearly described at the time of purchase.
- Unless otherwise stated, memberships auto-renew at the end of each billing period using your stored payment method, until cancelled in your account settings.
- If we increase the Membership Fee, we will notify you in advance and seek your confirmation before applying the new fee.
- Unless required by law, Membership Fees are non-refundable, except where OnlineDoc terminates your access to the Platform without cause, in which case we will provide a pro-rata refund for the unused portion of your membership.
13.5. Third-party payment or coverage
- In some cases, an employer, insurer or other third party may agree to pay some or all of your Fees or Membership Fees (“Third-Party Payer”).
- OnlineDoc is not a party to your contract with any Third-Party Payer.
- If third-party coverage changes or ends, you remain responsible for any Fees not covered.
- We may receive limited personal information about you from a Third-Party Payer (e.g. name, email, eligibility details) to administer coverage. Details are set out in our Privacy Policy.
13.6. Payment to Providers
- OnlineDoc facilitates the transfer of Fees to Authorised Providers for Healthcare Services provided via the Platform.
- Payment through the Platform is treated as though you paid the Provider directly.
14. OnlineDoc Referral & Credit Programmes
14.1. OnlineDoc may offer referral or credit programmes allowing Users to earn credits (“OnlineDoc Credits”) towards future Fees.
14.2. Details, including eligibility, credit amounts, expiry periods and usage rules, will be set out in your account or in specific programme terms.
14.3. General conditions:
- Credits are for personal use only and cannot be transferred, sold or exchanged for cash unless required by law.
- Credits must be used within the validity period; expired credits have no value.
- Credits may not be earned by creating multiple accounts or engaging in fraudulent or abusive activity.
- OnlineDoc may suspend or terminate your participation in any programme or adjust credits if we suspect abuse or error.
15. General Provisions
15.1. Entire agreement
These Terms, together with the Privacy Policy and any additional terms that may apply to specific services or programmes, constitute the entire agreement between you and OnlineDoc regarding the Platform and supersede all prior or contemporaneous agreements on the same subject.
15.2. Governing law and jurisdiction
These Terms and any dispute arising out of or in connection with them or the Platform are governed by the laws of Ireland, subject to any mandatory protections under the laws of your EU/EEA Member State of residence. The courts of Ireland shall have non-exclusive jurisdiction, without prejudice to any mandatory jurisdiction rules that apply for consumers.
15.3. Non-assignment
You may not assign, transfer or subcontract any of your rights or obligations under these Terms without our prior written consent. OnlineDoc may assign or transfer its rights and obligations under these Terms to another entity at any time without your consent.
15.4. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
15.5. No waiver
Any failure by OnlineDoc to enforce a provision of these Terms does not constitute a waiver of that provision or of the right to enforce it later.
15.6. No third-party rights
These Terms are not intended to confer rights on any person other than you and OnlineDoc, except where expressly stated.
16. Privacy Practices
16.1. Your use of the Platform is subject to the OnlineDoc Privacy Policy, which explains how we collect, use, store, share and protect personal data and Personal Health Information (“PHI”) in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR) and Irish data protection law.
16.2. By using the Platform, you agree that your personal data and PHI may be processed as described in the Privacy Policy.
16.3. Data Controller and Data Processor Roles For PHI created during consultations, the Authorised Provider acts as the Data Controller, responsible for clinical decision-making, clinical documentation and determining the purposes and means of processing such information. OnlineDoc acts solely as a Data Processor for the secure hosting, storage and transmission of such PHI on behalf of the Authorised Provider, and processes this information only in accordance with the Provider’s documented instructions and applicable law.
16.4. For personal data processed outside of clinical consultations (including account creation, billing, technical logs and customer support), OnlineDoc acts as the Data Controller, as outlined in the Privacy Policy.
17. Services Provided - No Medical Care or Advice by OnlineDoc
17.1. OnlineDoc provides an online communication and technology platform which enables Users to connect with Authorised Providers.
17.2. OnlineDoc itself does not:
- provide medical advice or clinical care;
- establish a doctor-patient or other healthcare professional-patient relationship with you;
- recommend or endorse any particular Provider, treatment, medication or product.
17.3. Any medical advice, diagnosis, treatment plan or prescription you receive via the Platform is provided solely by the Authorised Provider with whom you consult. Your clinical relationship is with that Provider, not with OnlineDoc.
18. Not for Emergencies
18.1. If you are experiencing a medical emergency, you must immediately dial 999 or 112 or attend the nearest emergency department.
18.2. The Platform is not designed or intended for emergency or urgent care. You must never delay seeking emergency treatment based on:
- information appearing on the Platform;
- an inability to access the Platform;
- or waiting for contact from a Provider via the Platform.
19. Risks of Telehealth Services
By using the Platform, you acknowledge and accept the potential risks associated with telehealth, including:
- incomplete or insufficient information for clinical decision-making;
- technical failures (hardware, software, internet, connectivity) that may delay or interrupt consultations;
- limitations in the Provider’s ability to perform physical examination;
- potential for unauthorised access or data breaches despite the use of reasonable security measures.
20. Prescription Policy
20.1. OnlineDoc does not endorse any specific medication, pharmacy or pharmacological product.
20.2. If a Provider prescribes a medication via the Platform:
- they will do so in their professional judgment and in accordance with applicable law and clinical guidelines;
- they may limit the supply or require in-person review before repeat prescriptions;
- there is no obligation to prescribe, and a Provider may refuse to prescribe any medication they consider inappropriate or unsafe.
20.3. Providers will not prescribe certain categories of controlled or high-risk medications via telehealth, save where local law and clinical guidelines explicitly allow and where they consider it appropriate.
20.4. You agree that:
- any prescription obtained via the Platform is solely for the person named on the prescription;
- you will follow professional advice, read all medication information provided and consult with a pharmacist or doctor if you have questions.
21. Not an Insurance Product
21.1. OnlineDoc is not an insurer and the Platform is not an insurance product.
21.2. Any amounts paid to OnlineDoc are for access to the Platform and services, not insurance premiums or contributions.
21.3. You remain responsible for arranging any health insurance coverage you require.
22. Availability of Services
22.1. The availability of the Platform and Healthcare Services depends on:
- the jurisdiction where you are physically located;
- whether OnlineDoc and the relevant Provider are permitted by law and regulation to provide services there.
22.2. Services are primarily intended for Users located in Ireland and in other jurisdictions where OnlineDoc has decided to make Services available and where Authorised Providers are licensed to practise.
22.3. You represent that:
- you are not prohibited from using the Platform under any applicable laws; and
- you will not use the Platform from a location where we have informed you that Services are not available.
23. Eligibility; Access, Security & Passwords
23.1. To use the Platform, you must:
- be at least 18 years of age; and
- have legal capacity to enter into binding contracts.
23.2. You agree to:
- create an account with accurate and complete information;
- keep your login credentials confidential;
- notify OnlineDoc promptly of any suspected unauthorised use of your account.
23.3. OnlineDoc may disable or terminate your account if:
- you breach these Terms;
- we suspect fraudulent or abusive activity;
- we are required to do so by law or regulatory authorities.
24. Electronic Communications
24.1. By using the Platform and providing your contact details, you consent to receive communications from OnlineDoc electronically (e.g., emails, in-app messages, SMS where applicable).
24.2. You agree that electronic communications satisfy any legal requirement that such communications be in writing, to the extent permitted by law.
24.3. You may manage certain communication preferences in your account settings or via unsubscribe mechanisms included in our messages, subject to legal and operational limitations (for example, we may still send essential service or account notices).
25. Consent to Receive Calls and Text Messages
25.1. Where permitted by law and where you provide your mobile number, you consent to being contacted by or on behalf of OnlineDoc at that number for:
- service-related communications (e.g., appointment confirmations, reminders);
- account verification;
- notifications about Platform features, subject to your marketing preferences.
25.2. Message and data rates may apply. You may opt-out of marketing SMS at any time as instructed in the messages you receive, but you may continue to receive essential service messages where permitted by law.
26. Accuracy of Information; Functionality
26.1. While we take reasonable care, we do not guarantee that:
- the Platform, its Content or any Product descriptions are free from error;
- defects will be corrected; or
- the Platform will always be available, secure and uninterrupted.

28. User Information and Acceptable Use
28.1. If you upload, submit or transmit any information, including health information, medical history, consents, documents, comments or other materials (“User Information”), you agree that it will not:
- be false, misleading, defamatory, abusive, obscene, harassing or unlawful;
- infringe any person’s privacy, copyright, trademark or other rights;
- contain viruses, malware or other harmful code.
28.2. You agree not to:
- use the Platform to send unsolicited communications (spam);
- misrepresent your identity or affiliation;
- attempt to harvest or collect personal or health information about other users;
- interfere with or disrupt the Platform’s operation or security.
28.3. You represent that you have all rights and authorisations necessary to provide the User Information and to permit its use in accordance with these Terms and the Privacy Policy.
29. Intellectual Property in User and Provider Content
29.1. Except for PHI and personal data, you grant OnlineDoc a non-exclusive, worldwide, royalty-free licence to use, store, reproduce, modify and display any non-PHI content you submit (e.g., feedback or comments) solely for the purpose of operating and improving the Platform.
29.2. Providers are responsible for obtaining all necessary consents and providing required notices to patients in respect of any Provider-generated content or documentation.
30. Disclaimer of Warranties (Site and Content)
30.1. OnlineDoc does not warrant that access to the Platform will be uninterrupted or error-free.
30.2. All Content is provided “as is” without any warranties, express or implied, except to the extent such warranties cannot be excluded under applicable law.
30.3. You are responsible for:
- implementing appropriate safeguards (e.g., antivirus software);
- securing your own devices and data backups.
31. Limitation of Liability - Site and Content
31.1. Except as provided by law and subject to Section 11 above, OnlineDoc shall not be liable for:
- any direct or indirect loss arising out of your use of (or inability to use) the Site, Content or linked websites;
- any errors or omissions in the Content;
- any loss resulting from unauthorised access to or alteration of your transmissions or data.
31.2. Your sole remedy for dissatisfaction with the Platform or its Content is to stop using the Platform.
32. Revisions
32.1. OnlineDoc may amend these Terms from time to time. Any changes will be effective when posted on the Platform (or at a later date specified in the notice).
32.2. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. You should review these Terms regularly.
33. Force Majeure
33.1. OnlineDoc will not be liable for any delay or failure to perform its obligations under these Terms due to events beyond its reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, civil unrest, strikes, lockouts, power outages, or failures of telecommunications or internet services.
